Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the services provided by TrueTone Systems ("Company," "we," "our," or "us"), including our website at truetonesystems.com, CrewCall AI, and all related AI automation services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our Services.

Description of Services

TrueTone Systems provides AI-powered automation solutions including:

  • Custom AI development and consulting
  • Workflow automation and system integration
  • CrewCall AI - AI-powered phone answering and appointment scheduling
  • Ongoing support and optimization services

Specific features and terms for individual services may be outlined in separate service agreements.

User Accounts

To access certain features of our Services, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your account credentials secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use

You agree to use our Services only for lawful purposes. You shall not:

  • Use our Services in violation of any applicable laws or regulations
  • Attempt to gain unauthorized access to our systems or networks
  • Interfere with or disrupt the integrity of our Services
  • Transmit malware, viruses, or other harmful code
  • Use our AI services to generate spam, fraudulent, or misleading content
  • Harass, abuse, or harm other users or third parties
  • Infringe upon intellectual property rights
  • Reverse engineer or attempt to extract source code from our Services

CrewCall AI Specific Terms

For users of our CrewCall AI phone system:

Call Recording Consent

You are responsible for obtaining appropriate consent for call recording in accordance with applicable laws. You must inform callers that their calls may be recorded.

Accuracy of Information

While our AI is designed to provide accurate responses, you acknowledge that AI systems may occasionally make errors. You are responsible for reviewing and verifying appointment bookings and other critical information.

Integration Access

By integrating CrewCall AI with third-party services (CRMs, calendars, etc.), you grant us necessary access to perform the requested functions. You are responsible for maintaining appropriate credentials and permissions.

Payment Terms

For paid Services:

  • Fees are as quoted in your service agreement or on our website
  • Payment is due according to the billing cycle specified in your agreement
  • All fees are non-refundable unless otherwise stated
  • We reserve the right to modify pricing with 30 days' notice
  • Late payments may result in service suspension

Intellectual Property

All content, features, and functionality of our Services, including but not limited to software, algorithms, text, graphics, logos, and designs, are owned by TrueTone Systems and protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services without our express written permission.

Your Content

You retain ownership of any content you provide through our Services. By using our Services, you grant us a license to use, process, and store your content as necessary to provide the Services.

Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • Our Services will be uninterrupted, secure, or error-free
  • Results obtained from using our Services will be accurate or reliable
  • Any errors or defects will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUETONE SYSTEMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

Our total liability for any claims arising from these Terms or your use of our Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless TrueTone Systems and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you provide through our Services

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of our Services.

Termination

We may terminate or suspend your access to our Services immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination:

  • Your right to use our Services will cease immediately
  • We may delete your account and associated data
  • Provisions that by their nature should survive will remain in effect

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Alberta, Canada.

Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our Services after changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and TrueTone Systems regarding your use of our Services.
